A traditional litigated divorce can be a difficult and drawn-out process, costly in both monetary and emotional terms. It does not have to be this way: if the parties are motivated to avoid the incredible expense and delays of litigation, they can decide to mediate their divorce.

A mediated divorce has the benefit of being the result of the mutual agreement of the parties -- not some determination by an overworked judge or combative divorce attorneys. The parties themselves drive the process, and with the assistance of a trained mediator, they are the ones deciding their future. And often -- more importantly -- their children's future.

A divorce mediation takes place over a number of meetings, often at the mediator's offices or sometimes even in the home -- wherever and whenever both the parties feel comfortable. It can happen very quickly or over a number of months, depending on the needs and schedules of the parties. Contrast that with the litigation process! 

Typically, we recommend that a divorcing couple use co-mediation, where two mediators are present, often one of each sex ... an extra set of ears and a different set of experiences helps the mediation progress, and ensures that no spouse is left feeling without voice or input. In very simple cases this may not be necessary, as with a young couple divorcing after a short marriage, without children and nominal assets.

After the parties have decided on the various allocations of assets, custody and other issues, we will draw up a Separation Agreement reflecting the agreement between them. This agreement should then be shown to an attorney to ensure that the party is in complete understanding of the terms of the agreement and its consequences. At the hearing, the judge will ask if each party has been afforded the opportunity to have an attorney to review the Separation Agreement.
